Terms and Conditions
(Usage Agreement)
Gift Life Co., Ltd. (hereinafter referred to as the "Company") promises the following regarding the "An Amazing Day Limited event" service (hereinafter referred to as the "Limited event"), and we would like our customers to also commit to the following: We would like to present to you these Terms and Conditions (hereinafter referred to as the ``Terms and Conditions'').
■Article 1 (Purpose of these terms and conditions)
These terms and conditions stipulate the rights relationship between the customer and the Company, and ensure that the interests, risks, etc. of both parties are equal, as the Company provides the ships necessary for this Limited event and other paid content based on the customer's request. It is intended to be set to. In addition, it is assumed that the contents of these terms and conditions have been communicated to everyone accompanying you other than the organizer, and that they understand and agree to them.
■Article 2 (Provision of this cruise)
1. Our company provides this Limited event to our customers with the duty of care of a prudent manager.
2. The content of this Limited event that we will provide to our customers will be determined by the application form, its accompanying documents, and a separate agreement between both parties.
3. The Company may freely outsource some of the services requested by the customer to a third party without the customer's individual permission.
■Article 3 (Payment of fees and other procedures)
1. If we receive an inquiry from the customer and agree on the contract details, we will issue a payment link and confirm the payment from the customer, and the reservation will be completed at the time of payment.
2. Unless otherwise approved by our company, customers must confirm the number of people on board (submit a separate sheet/boarding list) and other service details at least 6 days before the start of this Limited event.
■Article 4 (Voluntary cancellation by customer)
1. Customers may voluntarily cancel this Limited event before this Limited event begins, but in that case, they will be required to pay the following cancellation fee.

2 days before: 50% of Event participation fee fee

The day before: 80% of the Event participation fee fee

On the day: 100% of Event participation fee fee
*Cruise fee is the total amount including optional fees.
*For cancellations, please be sure to contact us via WhatsApp or phone by
5:00 pm. Cancellation by email or verbally is invalid. Contacts made after
5pm will be processed the next day.
2. If the customer voluntarily cancels this contract or cancels this Limited event at his/her discretion, even if it is due to bad weather or other unavoidable reasons, the cancellation fee set forth in Paragraph 1 will be incurred.
■Article 5 (Change of payment deadline and voluntary cancellation by our company)
1. Due to problems with the contract with the management company or other circumstances, the Company may, due to unavoidable circumstances, notify the customer of the fee (if a deposit has been paid) prior to the payment deadline or payment date, notwithstanding Article 3, Paragraph 4. The Company may request payment of all or part of the balance (remaining balance), and if the Customer refuses such payment, the Company may amend or voluntarily cancel this Agreement, and the Customer may object to this. You can not. Of course, in this case, any fees (deposit) you have already paid will be fully refunded.
2. Our company may voluntarily cancel this agreement if any of the following events occur to the customer, and if it is within the cancellation fee period set forth in Article 4, the prescribed cancellation fee will also be applied.

If it is discovered that the customer or the organization to which he or she belongs may violate laws, public order and morals, etc.

If the applicant fails to submit a copy of his or her identification card, or if the customer violates this agreement.
■Article 6 (cancellation, refund available)
In order to ensure the safe operation, our company may cancel or suspend the implementation of this Limited event if any of the reasons specified below apply. If a decision is made to cancel or suspend the service, the Company will promptly notify the representative and strive to cause as little inconvenience as possible. In this case, we will postpone the implementation of the service or refund all or part of the fees already received.
① Due to weather or sea conditions, it is extremely difficult to operate the ship as scheduled, and it may be necessary to perform this service while operating the ship or at berth, or to perform the service on a separate ship, on land or at sea, at a different pier, or at a different venue. If our company determines that there is a risk of danger, or if a public institution makes a decision to suspend the ship's operation.
② In the event of a natural disaster, fire, marine accident, breakdown of the vessel used, or other unavoidable circumstances.
③ When there is an order or request from a government agency
4. If congestion or an emergency situation poses a danger to the helicopter or ship
⑤ In cases where the vessel cannot be arranged, the capacity is exceeded, or it is extremely difficult to provide services as scheduled.
■Article 7 (Flight cancellation, no refund)
If any of the following events occur, your application will be canceled and the flight will be suspended. If it is within the cancellation fee period, a cancellation fee will also be charged.
Our company may cancel or suspend the implementation of this Limited event if any of the reasons specified below apply. Please note that in this case, we will not refund any fees already received, and if the full amount has not been paid at the time of cancellation or suspension, we will charge you for the remaining amount.
① In the event that major changes to this agreement are forced due to customer circumstances.
② If customers or other passengers do not follow the instructions of the captain and crew to avoid danger.
③ The customer is an anti-social force, etc. (meaning a member of an organized crime group, a member of a right-wing organization, an anti-social force, or any other person equivalent thereto), or maintains, operates, or manages an anti-social force, etc. through funding or other means. If the person has any kind of interaction or involvement with anti-social forces, etc., such as cooperating with or being involved in
④If a customer or other passenger engages in any of the prohibited acts stipulated in Article 9.
■ Article 8 (Changes to Operating Hours, Departure/Arrival Locations, Routes, etc.)
1. If it becomes significantly difficult to operate as scheduled due to any of the reasons listed in each item of Article 6, we may operate with a different aircraft or vessel, use a different departure or arrival location, or change the course or schedule. In that case, the departure and arrival locations may change and the departure and arrival times may be pushed back. Please set your cruise time with plenty of time, make sure all your companions are aware of it, and leave enough time after the scheduled cruise time to prepare for departure and arrival.
2. If it becomes extremely difficult to depart due to any of the reasons listed in Article 6, a postponed date may be set after consultation as soon as this becomes clear. However, if the purpose of using this Limited event becomes impossible to achieve due to postponement (if implementation according to paragraph 1 is also impossible), the full amount of the fee already paid will be refunded within one week from the date of cancellation. We will refund your money.
3. If departure is in doubt due to an approaching typhoon or other weather conditions, we will make a decision on whether or not to proceed three hours before each departure time and will contact the representative.
■Article 9 (Prohibited acts by customers)
The following acts are prohibited on this Limited event. If a customer engages in any of the above acts, our company will forcibly suspend operations and take other appropriate actions based on this agreement, laws and regulations, and the rules of good faith.
① Bringing in and using items that may catch fire or ignite, dangerous items, items that emit bad odors, items that are illegal to possess, etc.
② Jumping into the sea outside of authorized areas, throwing objects into the sea, etc.
③ Violence, abusive language, or other acts that may disrupt the peace on board.
④ Acts that may cause significant staining or damage to onboard equipment
⑤ Indecent acts such as drunkenness and nakedness
⑥ Acts that violate various laws and regulations, or other acts that our company deems inappropriate as a user.
■Article 10 (Points to note)
1. In order to prevent disturbance to surrounding facilities, etc., there are limits on the volume of both our own and brought-in equipment, so please enjoy the cruise within the volume specified here. There is a limit to the volume of sound flowing inside and outside the ship due to the sound of the ship's engine. Please note that we cannot take any responsibility for the effects of engine noise.
2. Please refrain from smoking and drinking alcohol if you are a minor, and if you are driving a car, please refrain from drinking alcohol. We may also ask you to present your ID to verify your age.
3. If the ship's equipment or ship is damaged intentionally or negligently by the customer, we may request actual costs and compensation for lost revenue opportunities due to the ship's inability to operate.
Article 11 (Cruising Service)
1. As a general rule, our company does not get involved in the planning, progress, or results of a customer's project, and does not assume any responsibility except in the case of reasons attributable to our company.
2. Please note that we are not responsible for any free services (e.g. food and beverages, photography support, etc.) intended to improve customer satisfaction.
Article 12 (Exclusion of anti-social forces)
1. The Company and the customer agree to the other party that, on the day this contract is concluded and in the future, the customer or the person using the Limited event at the same time as the customer falls under the following items (hereinafter referred to as "anti-social We hereby represent and warrant that we do not fall under the category of ``political forces''.
Organized crime groups, organized crime group members, associate members of organized crime groups, companies related to organized crime groups, corporate racketeers, etc., thugs who claim to be involved in political activities, social movements, etc., special intelligence violent groups, etc., symbiotic members of anti-social forces.
2. The Company and the Customer may terminate this Agreement without any notice if the other party determines that the other party falls under any of the following items based on reasonable grounds.
① If the person is or was an anti-social force.
② If you commit the following acts against the other party, either by yourself or by using a third party:
(A) Illegal or unreasonable demands
(b) Acts of violence, including acts of demonstration not limited to the use of tangible force
(c) Acts of persistently forcing transactions, such as purchasing information magazines.
(d) Acts of making demands on the other party by disguising attributes such as victim organizations
(e) Other acts prohibited by the "Act on Prevention of Unjust Acts by Organized Crime Group Members"
③ If you inform the other party that you are an antisocial force or a related party.
3. The Company and the Customer shall not be liable for any damages even if the other party suffers any damage as a result of canceling this Agreement pursuant to the preceding paragraph.
■Article 13 (Governing law and jurisdiction)
The governing law of this agreement shall be Japanese law, and the Tokyo District Court shall have the exclusive jurisdiction of the first instance for any disputes arising in connection with this agreement.
